To see the notice if you’re outside of the EU, view your blog and change the country code, for example blogspot.fr or blogspot.co.uk. If you use a custom domain, you won't see the notice outside of the EU.

I think that as long as you have a link on your site to a privacy policy that rambles about your "usage of visitor" data you are fine.

I use piwik, took their privacy policy and edited for my own use and added a few sentences here and there.
 
I've also first noticed that on a blogger blog I use for rss feed backlinks, funnily enough it makes blogspot worth less than nothing with that pop up drawing attention.

On galaxy s3 mini it covers half the screen. I know you just have to click Got it, but it's a pain in the sand.

But doubt that anybody bothered about this will go after minor upstarts. They're more likely concerned with giants, like g and banazon.

Note about banazon, saw a link to their disclaimer on their site around their header img, so I was wrong about the footer only link.

We talked some about it there. I did just see it on a blogger for the first time. A big bar across the top. I'm sure that's just to satiate the powers that be for now and it'll get toned down in the future.
