Do you have too choose one or the other? Do both.. Microsites are invaluable for ORM, and they provide a diversified backlink profile. It's also similar to a pbn, in that you can control how the sites are linked, and accumulate backlinks to microsites.
I would be very careful. People do this all the time, you can find plenty of clues between source code, contact form auto replies, and who is. If you have authority you shouldn't have problems. If these are two new sites with heavy SEO then probably best to not link them.
I would honestly just rewrite the article and move on. Sure maybe you could fight it an win, but what is the cost of re-writing the article.. $20? Rewrite and move on! Way better than legal fees.
